Access to the services offered by Distime is subject to the acceptance of the conditions described below, which Distime is free to modify at any time and without prior notice. The use of our services involves the processing of your information as described in our privacy policy. We invite you to familiarize yourself with it. The French version of this document prevails over all other languages.

Definitions

In this text, “event,” “group poll,” “poll,” and “Distime” have equivalent meanings.

User: refers to any individual or legal entity using the Services with or without creating an account with Distime, and who will be bound by these terms of use. To avoid any ambiguity, individuals or legal entities using the Services without a paid subscription or account (for example, as a guest by invitation) will be considered Users for the purposes of these terms of use. Initiators and guests are users.

Initiator: refers to the creator of a Distime.

Guest: refers to users invited to participate in a Distime.

Intellectual Property Rights

The concept of shared events on the internet or in a mobile application without strict identification (i.e., without a password and login), represented here under the name “Distime,” is protected by copyright. The name DISTIME, as well as all its logos, are registered trademarks. It is not permitted to use these trademarks for personal purposes, under any circumstances. The user of Distime agrees not to reproduce, copy, sell, trade, or transfer all or part of Distime’s services, under any pretext. They also agree not to conceal or modify our services (such as the Distime brand or advertisements, for example).

Brief Product Description

Distime is a tool that enables users to gather with friends or family to plan and participate in group activities (such as trips, restaurants, birthdays, vacations, sports, bars, parties, family gatherings, and more). Distime allows users to share their availability to participate in a group event. The availability status of members within a group poll is visible to everyone.

Distime is accessible online through the website www.distime.com, as well as through mobile applications. Events can be shared among friends via a sharing link. Distime’s mobile applications also allow users to create events even without an internet connection.

Tips for Optimal Use of the Tool

The hyperlink providing access to Distime should only be shared with individuals who are personally involved in the events and deemed responsible enough. Consider this link as the unique “key” to access the group poll.

While not limited, it is recommended to use Distime within a group with a limited number of participants (approximately 100 users).

Appropriate Usage Scope

Distime is suitable for family or friend use only, meaning it is intended for use among members of the same family or friends. Trust should be maintained within the group of users throughout the use of Distime. Therefore, you will use Distime solely because you want to plan a vacation or participate in a group activity with friends or family (leisure), and within this context, you want to know everyone’s availability to organize your event.

Access Conditions

You may not use Distime if the laws of the applicable jurisdiction prohibit you from receiving services as we offer them, if we have previously banned your account for a violation of these conditions, or if you are not of legal age to accept the terms of use.

The Service is not intended for individuals under the age of 16, and we ask such individuals not to provide personal information through the Service. If your child has submitted personal information and you wish to request the removal of that personal information, please contact us at privacy@distime.com or by mail at the following address: QWYLE Distime, 5 place de la pyramide, Puteaux 92800 France. As a user of Distime, you must always provide accurate data to Distime and the group participating in the events; always verify the information concerning you.

As a user of Distime, you expressly agree to NEVER: convey content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, racist, or otherwise objectionable; convey content that violates a patent or trademark; harm other users in any way; harass any other user or users in any manner; attempt to deceive or mislead other users; use Distime for email chains (such as hoaxes); intentionally impede or disrupt our services; use Distime in a manner that would be contrary to French law; violate, intentionally or unintentionally, any national or international laws or regulations in force, as well as any other rules with the force of law; reproduce, copy, sell, resell, or commercially exploit any part or use of our services, or any right of access to our services.

Distime is in no way responsible for the accuracy or precision of the data entered by you or your friends on Distime (availability as well as participant names on accounts). Distime will not act as an arbiter within your group and cannot be held responsible for the inaccuracy of certain data. In no event shall Distime be liable for any direct or indirect damages resulting from: improper use of its services, deemed illegal or fraudulent use of its services, inaccuracies in data within a group poll (a Distime), incorrect results provided by its services, temporary or permanent unavailability of its services, any failure of its services, or any cause related to its services.

Disclaimer

A Distime should NEVER have any contractual value in the eyes of the users. For the proper functioning of the tool, it is important that those who have access to the same Distime (friends, family, colleagues) are morally or contractually connected to each other.

An HTTP link provides access to Distime. This link is unique and cannot be modified. This link provides both read and write access to Distime. IT IS IMPORTANT TO NEVER SHARE THIS LINK WITH INDIVIDUALS WHO ARE NOT DIRECTLY INVOLVED IN THE GROUP POLLS OR WHOM YOU DEEM IRRESPONSIBLE!

This link should be treated as the access link to your Distime and handled with caution. In particular, it is strongly advised not to publish it anywhere, especially on social networks or forums.

The probability of “accidentally” finding this link is practically zero. However, it is not impossible for a stranger to acquire it: it can be intercepted by a hacker, retrieved from a computer’s memory, or simply copied from the browser history. Storing confidential information on a Distime is not recommended. If a user chooses to do so, they do so at their own risk. If you suspect that an outsider has accessed the poll, abandon the poll immediately and create a new one! You understand that Distime cannot be held responsible for the use that you or any member of your group make of the link to a group poll.

Suspension and Interruption of Access to Services

Distime has the right to temporarily or permanently stop its services (or a portion thereof), delete or modify them, or introduce new services without prior notice. Distime reserves the right (but is not obligated) to delete a Distime or ban one or more user(s) without any justification or prior notice.

Leaving a Distime

When you delete a Distime from your mobile application and/or your user profile (for example, because you are leaving an ongoing activity), it does not remove it from Distime’s servers. Other users may still want to access it. Additionally, by keeping the access link to the Distime, you may choose to access it later.

Permanent Deletion of a Distime

Due to the reasons mentioned in the previous point, it is currently not possible for a user to completely delete a Distime from Distime’s servers.

Additionally, when a Distime is no longer present in any user profile and has not been accessed for at least 24 months, it will become inaccessible. It will then be permanently deleted within an additional 12-month period. During this 12-month period, it can be restored upon request to our support service, provided it is still present in the database.

Privacy Policy

In order to provide you with our services, we collect certain personal information from you. We describe our collection and use of personal information in our privacy policy. Please review this policy before using Distime. You must be 16 years of age or older to use this service.

Applicable Law and Jurisdiction

These terms and conditions of use are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Paris, France.
